Frisco Peninsula Recreation Area and Frisco Adventure Park Commercial Use Permit Application

Thank you for applying for a Town of Frisco license agreement for commercial use of the Frisco Peninsula Recreation Area, including the Frisco Adventure Park, for athletic coaching or clinics. Please note that any commercial activity for which a fee is charged is required to have written authorization in advance by the Town, per § 130-22.

Special Event Permit Application

This is not a special event permit application and should not be filled out if you are applying to host a special event on Town of Frisco property, including at the Frisco Peninsula Recreation Area and the Frisco Adventure Park. The Recreation and Events Department administers a separate special event permit application for outdoor events on Town of Frisco property; this application is required for any event, whether free or not, which is open to the public for purposes of special entertainment for 50 or more people on Town property.

What does the Commercial Use of Trails and Open Space Permit Include?

Activities by businesses, organizations, or individuals who are not Town of Frisco employees or who are not already contracted with the Town of Frisco to provide these services include but are not limited to:

  • Public and private bike clinics
  • Private Nordic ski coaching
  • Terrain park coaching

Application Details and Requirements

  • A completed application
  • A Town of Frisco business license
  • Affirmation that they will be able to secure a Certificate of Insurance naming the Town of Frisco as a certificate holder and additionally insured for a minimum of $1 million

Please note that the Town of Frisco reserves the right to deny applications based on schedule, resources, or capacity.

  1. Application Timeframe: Applications must be submitted at least 21 days prior to license agreement use.
  2. Group Size: Licensee will uphold Agreement will be limited to the approved group size.
  3. User Days: Licensees may receive up to 200 user days per year. User days include participants and guides. Waived for qualifying nonprofits and Town of Frisco grant tecipients.
  4. Identification: While conducting coaching or tours on Town open spaces and trails, guide or coach/instructor will wear a form of identification or uniform that visibly identifies the Licensee.
  5. User Conflict: Licensee will minimize the impacts of its activities on public and Town land through client and guide education or training session. Use by the public should be expected and respected and user conflict shall be minimized.
  6. Indemnification: Licensee will indemnify and defend the Town, its officers, employees, and self- insurance pool, from and against all liability, claims, and demands on account of injury, loss, or damage, including, without limitation, claims arising from bodily injury, personal injury, sickness, disease, death, property loss or damage, or any other loss of any kind whatsoever, arising from:
    1. Licensee’s use of the Town’s Trail System pursuant to the License Agreement; or (ii) Licensee’s breach of the License Agreement; except to the extent any such injury, loss, or damage is caused by (a) Town’s breach of the License Agreement, or (b) the gross negligence or intentional wrongful act of the Town, its officers, employees or agents.
  7. Not Transferable: The License Agreement is not transferable to another operator or company.

Fees

  • 1-15 users: $5 per person/per day, up to 15 people
    • MULTIPLE USER DAYS: Fees are capped bi-annually at $200 per user for multiple user days, per season.
      • Summer season is May-October
      • Winter season is November-April
      • For example, coaches may train individuals or groups of 15 or fewer individuals for more than 15 days per season and fees do not exceed $200. Annually, fees do not exceed $400.
  • 16-30 users: $100 per day for groups of 16-30 people
  • 31+ users: Groups of over 30 users should contact Recreation@townoffrisco.com prior to submitting an application to ensure a Town of Frisco Special Event Permit is not required.
